California court: Prison pot is OK, if inmates don’t inhale


SACRAMENTO, Calif. — A California appeals courtroom says it is legal to have small amounts of marijuana in jail – as long as inmates don’t inhale.

The 3rd District Courtroom of Attraction dominated Tuesday that California voters legalized leisure possession of less than an oz of hashish in 2016 with no exception – even for those behind bars.

However the courtroom says state regulation does prohibit smoking or ingesting in jail. Jail officials may also still punish possession as a rules violation.

The courtroom overturned the convictions of five inmates who have been found with marijuana in their jail cells.

Lawyer Common Xavier Becerra’s office says it is reviewing the ruling and didn’t say whether or not will probably be appealed.

State corrections officials say pot possession continues to be towards the principles.
